Oxchord LLC ("we," "our," or "us") operates the Oxchord social media music app ("Oxchord" or the "App"). We are committed to protecting your privacy. This Privacy Policy explains our practices regarding the collection, use, and disclosure of information when you use our App.

Information We Collect

To provide you with a better experience while using the App, we may collect and store the following types of personal information:

  • Email Address: For account creation and login.

  • Photos: Uploaded by users to share within the App.

  • Music: Uploaded by users to share within the App.

  • Name & Username: For your account creation.

  • Location: Only as specific as what the user submits to the app (ex: putting “Denver, Colorado” in your profile). We do not track, collect, or geolocate your device.

  • Operating System: For our team to know what systems we should be making improvements to.

Use of Information

We use the information we collect to:

  • Provide and maintain the App.

  • Communicate with you about your account and respond to your inquiries.

  • Contact you to provide important information, required notices, and marketing promotions.

  • Improve and personalize your experience with the App.

Storage of Information

The information we collect is securely stored in our AWS S3 bucket and AWS Cognito. We take reasonable measures to ensure the security and confidentiality of your data. Your password is securely managed by AWS, and we do not have access to it. Sharing of Information

Oxchord does not sell or lease your personal information to third parties. We may share your information only in the following circumstances:

  • With service providers who assist us in operating the App and who are bound by contractual obligations to keep your information confidential and use it only for the purposes for which we disclose it to them.

  • If required by law or in response to a legal process such as:

    • to comply with a subpoena, or similar legal process;

    • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

    • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), Switzerland, or the United Kingdom (“UK”), you have the following data protection rights: 

  • Right of access: You may request Oxchord to confirm if information about you is processed. If such is the case, you will receive access to your information.

  • Right to rectification: If our information about you is incorrect, you may request Oxchord to rectify your information. This includes the right to have incomplete information completed, taking into account the purpose of the processing.

  • Right to erasure: you may request Oxchord to erase your information, for instance if the information is unlawfully processed, or if you have withdrawn your consent.

  • Right to restrict processing: You may request Oxchord to restrict the processing of your information, if (i) the information is inaccurate, (ii) the processing is unlawful, (iii) you need us to retain the information after the retention period for a legal claim, or (iv) you have objected to the processing and a verification of our legitimate interests is pending.

  • Right to object: You may object, on grounds relating to your particular situation, at any time to processing of personal data concerning them which is based on our legitimate interests.

  • Right to withdraw consent:  If we rely on your consent to process your personal data, you have the right to withdraw your consent at any time.

  • Right to data portability: You may request Oxchord to provide you with an electronic file of your information, or to transfer your personal data to a third party if such is technically feasible.

  • Right to lodge a complaint: You have the right to lodge complaints about the data processing activities carried out by Oxchord before a competent data protection authority. A list of EU data protection authorities is available here.

California Privacy Rights (CCPA)

Californians’ privacy rights under the passage of the California Consumer Privacy Act (CCPA) in 2018 provide them with certain protections other states do not. As such, the following bulleted list is your right to privacy while on Oxchord, and how it applies to our use of our platform:

  • The Right to Limit the use and disclosure of sensitive personal information collected about you. 

  • The Right to Opt-Out of the sale of your personal information and the sharing of your personal information for cross-contect behavioral advertising (e.g., targeted advertisements).

  • Right to Correct inaccurate personal information that businesses have about you.

  • Right to know what personal information we collected about you and how we share it.

  • Right to equal treatment. We cannot discriminate against you for exercising your CCPA rights.

  • Right to delete personal information we have about you.

Exercising Your GDPR and CCPA Rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.

Verification Process

When you submit a request, we will need to verify your identity to ensure the security of your personal information. We may ask you to provide additional information to confirm your identity.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated policy on this page and update the policy's effective date. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.

Data Retention Policy & Opt-Out Rights

We will retain User Provided data for as long as you use the App and for a reasonable time thereafter. If you'd like us to delete User Provided Data that you have provided via the App, please contact us at help@oxchord.com and we will respond in a reasonable time.

You can stop all collection of information by the App easily by uninstalling it. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Children

We do not use the App to knowingly solicit data from or market to children under the age of 13.

The App does not address anyone under the age of 13. The App does not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided personal information, we will immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us (help@oxchord.com) so that we may be able to take the necessary actions.

Security

Although we do not collect any data, we are committed to ensuring that any interactions within the App are secure.

Third Party Access

Only anonymized data is periodically transmitted to third parties as part of their own Privacy Policy. We may share your information with third parties in the ways that are described in this privacy statement.
